Terms of Service

These Terms of Service ("Terms") govern your access to and use of the AirNxt aviation maintenance software platform, including our web application, iOS application, APIs, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. Airnxt AI technologies LLC. ("AirNxt," "we," "us," or "our") is registered in the United Arab Emirates. These Terms constitute a legally binding agreement between you (or the organization you represent) and AirNxt.If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

AirNxt provides a cloud-based MRO platform for aviation maintenance management that includes:

- Digital logbook management (flight logs and maintenance logs)
- Airworthiness and CAMO compliance tracking
- Defect management (MEL and non-MEL)
- Parts and inventory management
- Asset and fleet management
- Personnel and qualification management
- Document management with workflow approval
- Offline-capable operation via device synchronization

The Service is designed to support aviation maintenance operations. It is a record-keeping and operational tool — not a replacement for the professional judgment of licensed aviation personnel, regulatory decision-making, or official airworthiness determinations. To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the accuracy of your account details.

You are responsible for:
- Safeguarding your login credentials
- All activity that occurs under your account
- Notifying us immediately at support@airnxt.ai if you suspect unauthorized access

We implement industry-standard security measures including encryption, role-based access control, and multi-factor authentication support. However, no system is completely secure, and you acknowledge this inherent limitation.

Organization administrators can invite users, assign roles, and manage access permissions. The organization administrator is responsible for managing user access and ensuring appropriate role assignments.

You own your data. Aviation data ownership is fundamental to our approach. All aviation operational data you enter into AirNxt — including logbook entries, maintenance records, defect reports, parts data, compliance records, personnel records, and documents — remains your property.

You may export your data at any time using the export features available within the platform. Supported export formats include CSV, Excel, and PDF where applicable.

No lock-in: Consistent with our product philosophy, we do not use data retention as a lock-in mechanism. If you choose to leave AirNxt, we will assist with data export upon request.

Upon account termination, you will have 90 days to export your data. After this period, your data will be deleted from our active systems, subject to any regulatory retention requirements that may apply to aviation maintenance records.

We may use aggregated, anonymized data derived from platform usage to improve the Service, develop new features, and generate industry insights. This data cannot be used to identify you or your organization.

You agree to use the Service in compliance with all applicable laws and regulations, including aviation regulations (EASA, FAA, GCAA, and other applicable authorities). You agree not to:

- Use the Service to store or transmit malicious code
- Attempt to gain unauthorized access to any part of the Service
- Reverse engineer, decompile, or disassemble the Service
- Use the Service to violate any applicable law or regulation
- Share your account credentials with unauthorized individuals
- Use automated scripts or bots to access the Service without our written consent
- Misrepresent data entered into the Service (aviation records must reflect actual events and conditions)
- Use the Service in any way that compromises aviation safety

AirNxt operates as a SaaS aviation maintenance platform and offers a free tier with limited functionality. Free tier accounts are subject to these Terms. We may modify free tier features or limitations at any time with reasonable notice.

Paid subscriptions are billed on a per-aircraft, per-month basis (or as otherwise specified in your subscription agreement). Payment terms:

- Subscriptions are billed in advance on a monthly or annual cycle
- All fees are exclusive of applicable taxes
- You authorize us to charge your designated payment method for recurring fees
- We will provide at least 30 days' notice of any price changes

You may cancel your subscription at any time. Upon cancellation:

- Your access continues through the end of the current billing period
- Your data remains accessible for 90 days after the billing period ends
- No refunds are provided for partial billing periods, unless required by law

We target 99.5% uptime for the cloud-hosted Service, measured monthly, excluding scheduled maintenance. Scheduled maintenance windows will be communicated in advance.

AirNxt supports offline operation. Core platform features function without internet connectivity, with automatic data synchronization when connectivity is restored. We are not responsible for data conflicts arising from extended offline operation if manual conflict resolution is required.

Support is available via email at support@airnxt.ai. Response times depend on your subscription tier and the severity of the issue.

The Service, including its design, code, features, documentation, and branding, is the intellectual property of Airnxt AI technologies LLC. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for your internal business operations.

If you provide suggestions, feature requests, or other feedback about the Service, we may use this feedback to improve the Service without obligation to you.

AirNxt is a record-keeping and operational support tool. It does not replace:

- Professional judgment of licensed aviation maintenance personnel
- Regulatory determinations by aviation authorities
- Official airworthiness assessments or certifications
- The responsibilities of CAMO, maintenance organizations, or operators under applicable regulations

Users remain responsible for ensuring compliance with all applicable aviation regulations. AirNxt facilitates record-keeping and tracking but does not independently verify the accuracy or completeness of data entered by users.

To the maximum extent permitted by law:

- AirNxt is provided "as is" without warranties of any kind, express or implied
- Our total liability for any claim arising from or related to the Service is limited to the fees you paid in the 12 months preceding the claim
- We are not liable for indirect, incidental, consequential, or punitive damages
- We are not liable for any loss arising from inaccurate data entered by users

We are not liable for failures or delays caused by events beyond our reasonable control, including natural disasters, government actions, internet service disruptions, or third-party service outages.

You may terminate your account at any time by contacting support@airnxt.ai or using the account settings within the platform.

We may suspend or terminate your account if:

- You breach these Terms
- Your payment is overdue by more than 30 days
- Your use of the Service poses a security risk
- Required by law or regulatory order

We will provide reasonable notice before termination, except where immediate action is required for security or legal reasons.

These Terms are governed by the laws of the United Arab Emirates. Any disputes arising from these Terms or your use of the Service will be resolved through:

1. Good faith negotiation (30 days)
2. Mediation under the rules of [mediation body — e.g., Dubai International Arbitration Centre]
3. Arbitration as a final resort, conducted in Dubai, UAE

We may update these Terms from time to time. When we make material changes:

- We will update the "Last Updated" date
- We will notify active users via email or in-platform notification at least 30 days before changes take effect
- Continued use of the Service after the effective date constitutes acceptance of the updated Terms
